was exerting undue influence in the probe.

He initially declined comment this week, then later said he "absolutely" felt no pressure from Bustamante's office.

"To me, it was just a legislator calling on behalf of a constituent, as they often do," said Brooks, now the department's director of school facilities planning.

He wrote the memo to Eastin, Brooks said, "just to give Delaine a heads-up."

"There was no pressure applied whatsoever," he added.

Federal officials say they never heard from Bustamante or his office as they probed the case, and Bustamante is not mentioned anywhere in the court file, which was obtained Thursday from archives at U.S. District Court in Sacramento.

Ross confirmed that Bustamante had called on behalf of his aunt and uncle, but said that "when he made the call, he did not suggest" investigators shut down their probe.

"He called to find out what they knew about it," Ross said. "There's no one you'll ever find who will say that Cruz Bustamante said in any way that it should not be looked into and dealt with."

Ross brushed aside the potential for further attacks, saying it can be expected when a candidate is ahead.

"We understand that comes with the turf," he said.
